The short version
A summary for orientation. The numbered sections below are the ones that bind, and where the two differ the numbered section wins.
- Gigxie is the venue, the buyer and seller are the contract. We host the marketplace, hold the money in escrow and arbitrate when the two of you cannot agree. We are not the buyer, the seller, or the employer of either.
- We take 0% of your order value, permanently. Section 6 turns that into a contractual promise with a notice period attached, so it is not a promotion we can quietly retire.
- The money is held before the work starts. Placing an order charges the buyer the price plus a service fee itemised at checkout, and moves the full price into escrow that second. Completing the order releases that whole price to the seller in one transfer, less the payment processor's fee, which we do not keep. Section 6 sets out both fees and how a refund returns them.
- Buyers get three days to accept. After delivery you have 72 hours to accept or open a dispute. If you do neither, the order completes on its own and the seller is paid.
- Cancellation has a hard cutoff. Either side can cancel while an order is still waiting to start. Once the seller starts work, the exits are delivery, mutual agreement or a dispute ruling.
- You own what you paid for. On completion, full rights in the delivered work transfer to the buyer, with narrow carve-outs for portfolios and pre-existing tools spelled out in section 13.
These terms are between you and Gigxie International Ltd., 14 Baggot Street Lower, Dublin 2, D02 XE71, Ireland (company no. 742118).
Accepting these terms
By creating a Gigxie account, placing an order, publishing a gig, or otherwise using gigxie.com or the Gigxie API, you agree to these Terms of Service ("Terms"). If you are using Gigxie for an employer or client, you confirm you have authority to bind that organisation, and "you" then means both you and it.
These Terms incorporate by reference our Privacy Policy and our Trust & Safety policies. Together they form the entire agreement between you and Gigxie International Ltd. and supersede anything discussed before you signed up, including anything a member of our team said in a sales conversation.
If you do not agree with any part of these Terms, do not create an account. If you already have one, close it under section 14 and any orders in flight will be settled under the rules that applied when they were placed.
1.1 Defined terms
- Buyer
- An account placing an order for a service.
- Seller
- An account offering a service, whether an individual freelancer or a registered business.
- Gig
- A published service listing with up to three package tiers, each with its own price, delivery time and revision count.
- Order
- A specific purchase of one package tier of one gig, with its own escrow position and lifecycle.
- Escrow
- Funds held by Gigxie's payment provider between the moment an order is placed and the moment it is settled.
- Delivery
- The seller marking an order delivered and submitting the work through the order workspace.
Eligibility
To use Gigxie you must be at least 18 years old and legally able to enter into a binding contract where you live. Where local law sets a higher age of contractual capacity, that higher age applies to you. We do not offer supervised, custodial or teen accounts.
You must not be subject to sanctions administered by the EU, the United Nations, the United Kingdom or the United States, and you must not be resident in a jurisdiction those sanctions cover. Our payment provider screens accounts against those lists and we act on what it reports.
One human, one account. Businesses may hold a company account operated by named staff, but you may not run several accounts to farm reviews, evade a suspension, bid against yourself or inflate a seller's ranking. Discovering a network of accounts operated by one person is grounds for suspending all of them.
Availability of Gigxie in your country does not mean the service you want to buy or sell is legal there. Complying with your own local law is your responsibility, and section 12 lists what is forbidden here regardless of where you are.
Your account
3.1 Registration and security
Sign-up requires an email address, a display name and a password of at least 8 characters. We store the password as a bcrypt hash and have no way to recover it for you; if you lose it, you reset it. Keep your credentials to yourself, and tell us at security@gigxie.com the moment you suspect someone else has them.
You are responsible for everything done through your account until you report it as compromised. Signing out ends the server-side session immediately, so a copied session cookie stops working at that moment rather than at its 30-day expiry.
3.2 Accurate information
Your display name, country, headline and bio must describe you truthfully. Impersonating another person, a brand, or a Gigxie employee is a permanent ban with no appeal. Selling work you did not do, or presenting a team's portfolio as an individual's, falls under the same rule.
3.3 Rate limits and fair use
Authentication endpoints accept 20 requests per 15 minutes per IP address. Scripted access to the public API is fine for your own account's data at a human pace; scraping the catalogue, hammering search, or automating account creation is not, and we will block the traffic before we ask about it.
3.4 Communication
Operational email — order placed, work delivered, dispute opened, payout sent — is part of the service and continues for as long as your account exists. Marketing email is opt-in and one click turns it off. Keeping a working email address on file is your responsibility; a bouncing address is not a defence against a deadline you missed.
Buyer terms
4.1 What you are buying
You buy one package tier of one gig. The price charged is always the price stored against that package at the moment you order — a price sent from your browser is ignored by our servers, so a tampered request cannot buy a $900 gig for $9.
The gig description, the tier's feature list, its delivery time and its revision count define the scope. Anything outside them is a new order or a paid extra, agreed in writing in the thread before the seller starts.
4.2 Your obligations
- Give a usable brief. Requirements you attach at checkout are what the seller works from. A delivery clock that has not started because you have not answered a blocking question is not a late delivery.
- Respond within a reasonable time. Sellers can request a cancellation if you are unreachable for 14 days on an order that needs your input.
- Keep it on-platform. Payment, files and communication stay inside Gigxie. Taking an order off-platform ends your escrow protection, your dispute rights and your review, and it is a violation under section 12.
- Do not resell an order as your own service. You may use delivered work in your own commercial projects — see section 13 — but relisting a seller's delivery as a gig of yours is prohibited.
4.3 What Gigxie does not promise you
We check that sellers are real, that their reviews come from real completed orders, and that their listings are not obviously fraudulent. We do not pre-screen the quality of anyone's work or guarantee the outcome of any engagement. Judgement about whether a seller fits your project is yours, and escrow plus the dispute process in section 10 is the protection we provide if that judgement goes wrong.
Seller terms
5.1 You are independent
You are an independent contractor. Gigxie is not your employer, agent or partner, and nothing here creates employment, a joint venture or an exclusivity arrangement. You set your prices, choose your clients, decline whatever you like, and work wherever else you want, including on competing platforms and directly with your own clients. Your own taxes, insurance and business registration are yours to handle.
5.2 Listings must be honest
- Publish only services you can personally deliver, at the quality your samples imply.
- Portfolio samples must be your own work. Using someone else's work to win an order is fraud, and we treat it that way.
- Delivery times and revision counts must be ones you intend to meet. Publishing a 24-hour delivery you routinely miss damages your ranking long before it reaches us.
- Prices are per package tier and range from $5 to $10,000 per gig. Bait pricing — a low headline tier that cannot deliver anything usable without a mandatory extra — is a listing violation.
- Listings must sit in the right category and must not be duplicated across several gigs to occupy more search results.
5.3 Delivering and getting paid
Once you start an order you commit to the scope, the delivery date and the revision count of the tier the buyer bought. Deliver through the order workspace, because that timestamp is what any later dispute is measured against. When the order completes, the full order price is released from escrow to your balance, less the payment processing fee described in section 6.3, and you can withdraw it to a bank account, PayPal or Wise; payouts are normally sent within 24 hours and there is no minimum balance.
5.4 Levels
Seller levels are earned from completed orders, on-time delivery rate, rating and response time, and they are recomputed from those records rather than being assigned by hand. A level can go down as well as up. Buying reviews, trading reviews with another seller, or completing token orders with an account you control will reset your level and usually end your account.
5.5 Withdrawing a gig
You may pause or delete a gig at any time. Doing so hides it from search and stops new orders, and it has no effect on orders already in flight, which you must still complete or resolve under sections 8 to 10.
Fees: 0% seller commission, the buyer service fee and payment processing
Gigxie charges sellers no commission and no percentage of any kind on the value of an order. Two fees do exist, and this section states both in full: a buyer service fee charged on top of the order price, which is Gigxie's revenue, and a payment processing fee deducted from the seller's payout, which is a third-party cost that Gigxie does not keep.
List a $500 logo and a buyer orders it: the buyer is charged $529.50 ($500 plus a $29.50 service fee, itemised at checkout), $500 goes into escrow, and on completion $485.20 reaches your balance — the full $500 less $14.80 of card processing charged by our payment provider. Gigxie's commission on your $500 is $0.00, and no tier, subscription or promotion changes that number.
Our software enforces the commission part rather than merely promising it: the payment module asserts that the amount released from escrow equals the amount held, the two fees are recorded as their own separate ledger entries so neither can hide inside that check, and our test suite fails the build if any change skims a cent. Our admin console rejects any attempt to set a seller commission rate with an error, so there is no dashboard toggle a future operator could flip.
6.1 The 0% seller commission is a commitment, not a promotion
We will not introduce a commission on order value for any seller. If Gigxie ever intends to change this section, we will give every seller at least 180 days' written notice, during which you may withdraw your full balance and close your account with no penalty and no clawback. Any order placed before such a change takes effect settles under the terms that applied when it was placed.
6.2 The buyer service fee
Gigxie charges the buyer a service fee in addition to the order price. It is calculated as a percentage of the order price plus a flat amount, and the current rate is 5.5% of the order price plus $2.00. It is not deducted from the seller's price and does not reduce the amount held in escrow.
- The fee is calculated and displayed before payment, itemised on the checkout screen as its own line alongside the order price and the total. Placing an order is the first and only point at which it is charged; nothing is added at a later step.
- It is computed on our servers from the published package price. No figure sent by your browser can influence it.
- It is charged as its own entry on the order's record, separate from escrow, and appears on the order receipt.
- This fee is Gigxie's revenue and pays for escrow, dispute handling, support and the platform.
6.3 The seller payment processing fee
When an order settles in the seller's favour, a payment processing fee is deducted from the amount released to the seller. The current rate is 2.9% of the order price plus $0.30, and it is capped at the order price so a payout can never be negative.
This charge covers card-acquiring and payment-network costs levied by our payment provider. Gigxie does not keep any part of it, does not count it as revenue, and cannot waive it. It is shown as its own line on the order and on your earnings page, separate from the escrow release, precisely so it is never mistaken for a commission.
6.4 Rates are shown at checkout and frozen per order
Both rates above are the rates in force at the time of publication and may change. A change takes effect for new orders only. When an order is placed, the service fee, the processing fee, the buyer's total, the seller's payout and the rates that produced them are calculated once and stored on that order permanently. A later rate change cannot alter an order that has already been placed, and no stored order's fees are ever recomputed from current rates.
All amounts are calculated in whole cents, rounded to the nearest cent once per fee at the moment of calculation, with a half-cent rounded up. The rate applying to your order is the one displayed on the checkout screen you confirmed.
6.5 How fees are treated on a refund
Both fees are returned with a refund rather than retained, in the same proportion as the refund itself:

A cancelled order therefore costs the buyer nothing at all: the service fee is not retained as a cancellation charge. Every settlement is computed from the fee amounts frozen onto the order, and each fee's refunded and retained halves are derived so that they always sum exactly to the amount originally charged. No cent is created or lost in a settlement, and the transaction is refused if that does not hold.
6.6 Our other revenue
- Gigxie Pro
- An optional seller subscription: extended analytics, priority support and multi-seat team accounts. It changes nothing about your earnings on an order if you never buy it, and nothing if you do.
- Promoted listings
- Sellers who want additional placement in search results can bid for it on a cost-per-click basis, with a budget cap they set. Promoted results are labelled as such to buyers. Organic ranking is never sold.
- Gigxie for Business
- Team billing, consolidated invoicing, procurement approvals and a dedicated account manager, sold to companies that buy at volume.
None of these is deducted from an order. They are separate products, billed separately. Together with the buyer service fee in 6.2, they are the entire revenue model.
6.7 What else buyers pay
Nothing beyond the order price and the service fee in 6.2. Currency conversion, if your card is not in the order's currency, is applied by your own bank at its rate and is outside our control. There are no listing fees, no withdrawal commission and no charge for opening or escalating a dispute.
Orders, payment and escrow
7.1 The order lifecycle
Every order moves through a fixed set of states, and each transition is restricted to one party. This is the whole machine:

7.2 Escrow
Placing an order charges the buyer the order price plus the service fee (6.2) and moves the full order price into escrow immediately. The seller cannot touch it and the buyer cannot recall it unilaterally; it leaves escrow only through completion, cancellation or a dispute settlement.
Every movement writes one immutable ledger entry — hold, release, refund or payout — recorded in integer cents. Your balance is the sum of your entries, which is why it always reconciles. Nothing in the product can edit or delete a ledger entry; a correction is a new compensating entry.
When a dispute settles with a split, the refunded amount and the released amount are required to sum exactly to the order price before a single entry is written, and a second attempt to settle the same dispute is rejected. Neither party can be paid twice and no money can be created.
7.3 Gigxie's role in the money
Gigxie holds escrowed funds through a regulated payment provider on behalf of the parties. Escrowed funds are not a deposit, do not earn interest for you, and are not a banking service. We are not a bank, a money transmitter of your funds beyond this role, or a party to the underlying service contract.
7.4 Chargebacks
Raise a dispute here before raising one with your card issuer. A chargeback filed on an order that was delivered and accepted, or that a Gigxie dispute already resolved, is treated as an attempt to recover money twice: we will contest it with the order record, and we may suspend the account pending the outcome.
Delivery, the acceptance window and revisions
8.1 The delivery clock
The delivery deadline is the package's delivery time counted from when the order was placed, and it is shown on the order as a specific date and time rather than a vague estimate. If the seller needs information only the buyer has, the clock is paused from the moment the seller asks in the thread until the buyer answers.
8.2 The 72-hour acceptance window
When a seller marks an order delivered, the buyer has three days (72 hours) to do one of three things:
- Accept the delivery. The order completes and the full amount is released to the seller straight away.
- Request a revision, if the package includes one that is unused. The seller reworks and delivers again, which starts a fresh 72-hour window.
- Open a dispute under section 10, which freezes escrow until the dispute settles.
If none of those happen, the order auto-completes at the 72-hour mark and the seller is paid in full. The exact deadline is shown on the order page and counts down to the same instant our servers use, so there is no ambiguity about when it passes. An order that has auto-completed cannot be disputed retroactively, because the money is already the seller's.
8.3 Revisions
A revision request must be about the agreed scope. Asking for a different concept, a new brand direction or additional deliverables is a new order rather than a revision, and a seller may decline it as out of scope. Sellers may offer revisions beyond the package count as a courtesy, and doing so does not create an obligation to keep doing it.
8.4 Late delivery
If a seller has not delivered by the deadline, the buyer may open a dispute immediately, without waiting for a delivery that may never come. Repeated late delivery lowers a seller's level and their search ranking automatically.
Cancellations and refunds
9.1 Before work starts
While an order is still in the placed state — meaning the seller has not started it — either party may cancel with one click. The order price and the entire service fee are refunded to the buyer immediately, so a cancelled order costs the buyer nothing, and neither side's statistics are affected.
9.2 After work starts
Once the seller starts, the order cannot be cancelled unilaterally by either party. This protects sellers from having work pulled out from under them mid-project, and it protects buyers from a seller who abandons a job to avoid a bad review. From that point there are three exits:
- Delivery and acceptance under section 8.
- Mutual agreement. One party proposes a settlement in the dispute workspace and the other accepts it. A seller offering the full price back, or a buyer offering the seller everything, settles at once because there is nothing for the other side to object to.
- A dispute ruling under section 10.
9.3 Grounds for a full refund
A dispute will normally resolve as a full refund where the seller never delivered, where the delivery is materially different from what the gig described, where the work is plagiarised or infringing, or where the seller is unreachable for seven days after a missed deadline. Dissatisfaction with a delivery that matches the description and used its revisions is normally a partial refund at most.
9.4 Refunds are to balance, then to source
Refunded amounts return to your Gigxie balance, together with the service fee treated as set out in section 6.5 — in full on a full refund, proportionally on a partial one. You may spend the balance on another order or withdraw it to the original payment method. Card refunds typically appear within 5 to 10 business days depending on your issuer, which is outside our control.
9.5 Completed orders
Once an order completes, escrow is empty and the money belongs to the seller. Neither our support team nor our admin console can reverse it, and this is a deliberate constraint rather than a policy we can make an exception to — paying the buyer back at that point would create money that does not exist in the ledger. Anything after completion is a matter between you and the seller, or between you and your card issuer.
Disputes, escalation and arbitration
10.1 When a buyer can open a dispute
A buyer may open a dispute on an order that has been delivered, or on an order that is in progress and past its delivery deadline. You choose a reason — not delivered, not as described, quality, late, or other — and describe the problem in up to 4,000 characters. Opening a dispute moves the order to disputed and freezes escrow.
10.2 Working it out between yourselves
A dispute has its own message thread. Either party can propose a settlement: any split of the order price between refund and release. The service fee and the processing fee follow that split in the same proportion, as set out in section 6.5. The other party accepts or rejects it. An accepted proposal settles immediately and the order closes as completed or cancelled depending on the split. Most disputes end here, usually within a day.
10.3 Escalating to Gigxie
Either party can escalate to our Trust & Safety team once 48 hours have passed since the dispute was opened, or immediately after a proposal has been rejected. A named specialist reads the order, the delivery, both message threads and the ledger, then rules: refund in full, refund in part, or release in full to the seller.
We aim to rule within three business days. The ruling is final within Gigxie, executed once, and it settles escrow exactly. You may appeal once, within 14 days, to a second reviewer who was not involved in the first decision, by writing to disputes@gigxie.com.
10.4 Withdrawing a dispute
A buyer may withdraw a dispute at any time before it settles. Doing so releases escrow to the seller in full and closes the order as completed.
10.5 Disputes with Gigxie itself
Sections 10.1 to 10.4 cover disputes between a buyer and a seller. If your dispute is with us — about your account, our fees, or these Terms — write to legal@gigxie.com first. We commit to a substantive reply within 30 days, and most complaints end there.
If that fails, you and Gigxie agree to submit the dispute to binding arbitration under the Arbitration Rules of the Dublin International Arbitration Centre, before a single arbitrator, seated in Dublin, conducted in English, and, at your election, held by video conference. Each party bears its own costs and half the arbitrator's fee, and we will pay your share of that fee for claims under €10,000 if you ask.
Your carve-outs. Either party may bring a claim in a small claims court instead. Either party may seek an injunction from a court to stop intellectual property infringement or account misuse. If you are a consumer resident in the EEA or the UK, nothing here removes your right to bring proceedings in the courts of your own country of residence, or to use the European Commission's Online Dispute Resolution platform.
No class actions. Claims are brought individually. You and Gigxie each waive any right to participate in a class, collective or representative action, to the extent that waiver is permitted where you live.
Reviews and ratings
Only a buyer with a completed order can review the gig it was placed against, and only once per order. There is no way to review a seller you have not hired, and no way to buy or gift a review into anyone's profile. Every rating on this site is anchored to a real order with a real payment behind it.
Your review is published with your display name and country, and it recomputes the gig's public rating. Reviews are permanent: neither buyers nor sellers can delete one because it went badly.
11.1 What a review must be
- Your own honest experience of the order you placed.
- About the work and the working relationship, without personal data about the seller, threats, slurs or content unrelated to the order.
- Free of any inducement. Offering a refund, a discount or an extra deliverable in exchange for a rating is review manipulation and costs the seller their level.
11.2 When we remove a review
Gigxie removes a review only where it breaks the rules above, contains personal data, is part of a coordinated attack, or is the subject of a valid legal order. Removal rolls the gig's running average back to what it was. We do not remove reviews on request from the seller, and we do not remove them because they are harsh.
11.3 Responding
Sellers may publish one public reply to each review. It is the better move: a calm, specific reply to a two-star review reads far better to future buyers than the review itself.
Prohibited services and conduct
The following are forbidden on Gigxie regardless of whether they are legal where you live. This list is illustrative rather than exhaustive, and our Trust & Safety page keeps the current detailed version.
12.1 Prohibited services
- Academic work submitted as a student's own: essays, dissertations, take-home exams, sat assessments.
- Fake engagement of any kind — purchased followers, votes, installs, streams, or reviews on any platform including this one.
- Adult or sexual content, escort services, and anything involving minors in a sexual context.
- Weapons, drugs, controlled substances, and services that facilitate obtaining them.
- Hacking, credential theft, DDoS, malware, spyware, and "recovery" services targeting accounts you do not own.
- Counterfeit goods, pirated software, cracked licences, and stolen digital assets.
- Impersonating a real person or brand, forging documents, and creating fake identification.
- Guaranteed medical, legal, financial or immigration outcomes, and any professional advice you are not licensed to give.
- Gambling operations, lottery services, pyramid and matrix schemes, and money-transfer or cash-out services.
- Political disinformation campaigns, astroturfing, and coordinated inauthentic behaviour.
12.2 Prohibited conduct
- Going off-platform. Soliciting or accepting payment outside Gigxie for work found here, or sharing contact details to arrange it, on a first offence costs you the order and on a second costs you the account.
- Manipulating reputation. Review trading, self-ordering, sock-puppet accounts, or pressuring a buyer to change a rating.
- Harassment. Threats, hate speech, sexual harassment, doxxing, or contacting someone off-platform after they have asked you to stop.
- Spam. Unsolicited bulk messages, off-topic promotion in threads, or scraping the marketplace to build a contact list.
- Abusing the money. Structuring orders to move funds rather than to buy a service, using stolen payment credentials, or filing chargebacks on delivered and accepted work.
- Circumventing enforcement. Creating a new account after suspension, or operating one on a suspended user's behalf.
12.3 Enforcement
Depending on severity and history we may remove a listing, cancel and refund an order, restrict a feature, reset a seller level, suspend an account or terminate it permanently. Fraud, sexual content involving minors, and threats of violence are immediate permanent bans with no warning and, where appropriate, a report to law enforcement. Everything else gets a notice explaining what happened and how to appeal, at appeals@gigxie.com.
Intellectual property and ownership of delivered work
Buyers: when the order completes, the work is yours. You can use it commercially, modify it, register a trademark on the logo, and you owe the seller nothing further. No licence to renew, no royalty, no usage cap.
Sellers: you keep the right to show finished work in your portfolio unless the buyer bought a confidentiality upgrade, and you keep the tools, templates, brushes and code libraries you built beforehand. Selling the same deliverable twice is what you cannot do.
13.1 Transfer on completion
On completion of an order, the seller assigns to the buyer all right, title and interest in the deliverables produced specifically for that order, including copyright, worldwide and in perpetuity, insofar as those rights are assignable in the seller's jurisdiction. Where an outright assignment is not possible, the seller grants the buyer an exclusive, irrevocable, worldwide, royalty-free licence to use, modify, sublicense and commercialise the deliverables for any purpose.
Transfer happens at completion, not at delivery. Until escrow releases, the seller retains ownership, which is what stops a buyer from taking the files and disputing the payment.
13.2 What the seller keeps
- Pre-existing material. Tools, templates, code libraries, brushes, presets and methods that existed before the order. The buyer gets a perpetual, non-exclusive licence to whatever pre-existing material is embedded in the deliverable, so the deliverable is fully usable.
- Third-party assets. Stock photography, fonts and plugins remain governed by their own licences. Sellers must disclose them at delivery and must not deliver work that depends on a licence the buyer does not have.
- Portfolio rights. A non-exclusive right to display the completed work as a sample, waived where the buyer has purchased a confidentiality upgrade or the parties sign an NDA.
- Moral rights, where they cannot be waived under local law, though the seller agrees not to assert them in a way that obstructs the buyer's ordinary use of the work.
13.3 Warranties from the seller
By delivering, the seller warrants that the work is original, that they have the right to assign it, that it does not infringe anyone's rights, and that any AI tools used are disclosed where the buyer asked about them. Delivering plagiarised or infringing work is grounds for a full refund under section 9.3 and for termination under section 14.
13.4 Content you post to Gigxie
You keep ownership of your listings, portfolio samples, messages and reviews. You grant Gigxie a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content solely to operate and promote the marketplace — showing your gig in search results, featuring it on a category page, or including it in a marketing screenshot. Delete your content and the licence ends, apart from copies in backups and in the reviews that stay attached to a seller's record.
13.5 Gigxie's own marks
The Gigxie name, wordmark, logo and site design are ours. Sellers may say they work on Gigxie and link here; nobody may imply endorsement, partnership or employment by Gigxie without written permission.
13.6 Infringement notices
Send takedown notices to ip@gigxie.com with the work, the infringing listing, your contact details and a statement of good-faith belief. We remove content promptly, notify the seller, and accept counter-notices. Repeat infringers lose their accounts.
Suspension, termination, disclaimers, liability and legal terms
14.1 Suspension and termination by Gigxie
We may suspend or terminate an account that breaches these Terms, that we reasonably believe is engaged in fraud, or where we are required to by law. A suspended account cannot sign in and cannot act on any part of the service, including placing orders. Except where a delay would cause harm or is legally prohibited, we give notice with reasons and a route to appeal.
On suspension, orders in flight are settled fairly rather than left frozen: undelivered orders are refunded to buyers, and delivered work already accepted is paid out to the seller. Balances are payable to you unless they are subject to an open dispute, a chargeback or a legal hold.
14.2 Closing your own account
Close your account whenever you like from Settings, with no notice period and no exit fee. Complete or settle any open orders first — closing an account does not cancel a live order or release escrow. Sections 7, 9, 10, 13 and 14 survive termination.
14.3 Availability
We aim for high availability and publish incidents on our status page, but the service is provided without an uptime guarantee. We may change, suspend or discontinue features with reasonable notice where the change is material.
14.4 Disclaimers
To the fullest extent permitted by law, Gigxie provides the platform "as is" and "as available", and disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement and quiet enjoyment. We do not warrant that any seller will meet your expectations, that any buyer will be reasonable, or that the service will be uninterrupted or error-free.
Gigxie is not a party to the contract between buyer and seller. We do not supply the services listed here, we do not employ sellers, and we do not guarantee the quality, legality, accuracy or timeliness of any work delivered through the platform.
Nothing in this section limits rights you have as a consumer under mandatory law in your country of residence, including statutory guarantees that cannot be excluded by contract.
14.5 Limitation of liability
To the fullest extent permitted by law, neither Gigxie nor its directors, employees or suppliers is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising from your use of the platform.
Our total aggregate liability to you for any claim is limited to the greater of (a) the total amount you paid to or received through Gigxie in the six months before the claim arose, and (b) €100.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
14.6 Indemnity
You will indemnify Gigxie against claims, damages and reasonable legal costs arising from your breach of these Terms, your infringement of someone else's rights, or the services you buy or sell through the platform. We will tell you promptly about any claim and let you control the defence of it, provided any settlement releases us fully.
14.7 Governing law and jurisdiction
These Terms are governed by the laws of Ireland, without regard to conflict-of-law rules. Subject to the arbitration agreement in section 10.5, the courts of Ireland have exclusive jurisdiction. If you are a consumer resident in the EEA or the UK, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts.
14.8 Changes to these Terms
We will give at least 30 days' notice by email and on-site before a material change takes effect, and at least 180 days before any change to section 6. Continuing to use Gigxie after a change takes effect means you accept it; if you do not, close your account before that date. Orders placed before a change settle under the version that applied when they were placed. Previous versions are available from legal@gigxie.com, including a redline against the current text.
14.9 General
- Severability. If a provision is unenforceable, the rest stays in force and the provision is read as narrowly as needed to make it valid.
- No waiver. Not enforcing a term once does not waive it later.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or to an acquirer of the business.
- No third-party rights. Nobody outside you and Gigxie can enforce these Terms.
- Language. The English version controls. Translations are provided for convenience.
- Force majeure. Neither party is liable for failures caused by events genuinely beyond its reasonable control.
